Transparency International Sri Lanka (TISL) echoes the concerns expressed by human rights actors on the Protection of the State from Terrorism Bill, gazetted on the 22nd of September 2026, which proposes to replace the Prevention of Terrorism Act (PTA). Significant concerns remain regarding its broad definitions of terrorism, expanded executive powers, administrative detention and restrictions on fundamental freedoms.
TISL recognises the State’s responsibility to address legitimate national security concerns. However, counter-terrorism legislation must not undermine fundamental rights, due process, judicial independence or the democratic space necessary for public participation and dissent.
Overbroad Definitions and Risks to Civic Freedoms
The Bill’s definition of terrorism includes a broad range of acts involving damage to property, the environment, cultural property and electronic systems, as well as acts that create risks to public health. There is an absence of sufficiently stringent requirements concerning intentionality and a high likelihood of serious harm which risks bringing conduct that should be addressed through ordinary criminal law within the scope of terrorism offences.
Such breadth may also extend the reach of associated offences, including aiding and abetting and the dissemination of terrorist publications, increasing the risk that legitimate expression, association and civic activity could be subjected to disproportionate restrictions.
Military Involvement in Law Enforcement
TISL is concerned that the Bill grants the armed forces and Coast Guard extensive powers of arrest, search, seizure and questioning. The continued authorisation of military involvement in law enforcement, alongside broad powers to prevent suspected offences, raises concerns regarding due process, accountability and the protection of individuals against arbitrary action. The absence of clear provisions establishing the applicable safeguards, transparency, and chains of command when military personnel exercise these powers further heightens the risk of accountability gaps.
Administrative Detention and Limited Judicial Oversight
The proposed detention framework raises serious concerns regarding the protection of personal liberty and the role of the judiciary. The Bill permits detention orders to be issued by the Secretary to the Ministry of Defence, with an initial detention period of two months, while limiting the Magistrate’s ability to independently assess the necessity of detention and determine whether remand or release is justified.
Further concerns arise from the limited authority of the proposed Review Committee to make recommendations that may be rejected by the Minister. These mechanisms risk concentrating excessive discretion in the executive at the expense of judicial oversight.
Executive Powers and Restrictions on Civic Space
TISL is also concerned that the Bill also empowers the President to proscribe organisations, with significant consequences for their ability to operate, raise funds, conduct meetings and engage in advocacy. The absence of a specified time limit for proscription orders and the limited safeguards governing their imposition raise concerns regarding transparency, accountability and the potential for arbitrary restrictions on freedom of association.
Additional powers relating to restriction orders, prohibited places and directions concerning the enforcement of the Act require scrutiny to ensure that they are necessary, proportionate, subject to effective review and not used to restrict legitimate public activity.
TISL urges the Government to withdraw the Protection of the State from Terrorism Bill 2026 and repeal the Prevention of Terrorism Act without further delay. The Government must ensure that any replacement for the PTA establishes clear legal limits on executive authority, effective accountability mechanisms and adequate safeguards against arbitrary detention and the abuse of counter-terrorism powers.
