TISL calls upon public authorities to commit towards more transparency on International Right to Know Day

Former American President Abraham Lincoln once said “Let the people know the facts, and the country will be safe”. The statement denotes that a country’s well-being is likely to depend on how accessible its information is. International Right to Know Day was initiated to create an international discourse on access to information and to make it a part of the general civic consciousness. Later, the United Nations declared September 28 as the International Day for Universal Access to Information.

Celebrating International Right to Know Day, as Transparency International Sri Lanka (TISL) also marks its 20th year of contributing to the collective effort to fight corruption in Sri Lanka, is especially significant. TISL has continued to walk with citizens in their RTI journey, striving to ensure and protect the right to information, since its operationalization in Sri Lanka.

The right to information is the strongest available tool in the fight against corruption, due to the obligation it places upon public authorities to be accountable and responsive to citizens through a mandatory legal mechanism. As such, International Right to Know Day is not a day merely for celebration, but a moment to create wider and deeper knowledge on the right, and for public authorities to reflect on whether they are truly serving this sovereign right of the citizens.

Countries around the world have adopted this right through legal provisions, placing obligations upon public authorities to various extents. In Sri Lanka, the term ‘public authorities’ includes – government ministries, government departments, public corporations, local authorities, any institutions created by a Provincial Council, non-governmental organizations, institutes of higher education, private educational institutes and all courts, tribunals and institutions created to serve justice. The Right to Information Act places an obligation on these authorities to provide information to citizens efficiently and transparently. Adhering to the provisions of the Act can promote transparency and accountability of these institutions and empower citizens to exercise their democratic rights.

Further, providing information before it is requested, i.e. proactive disclosure, is one of the foremost aspects of open government and of the right to information. The Right to Information Act mandates public authorities to disclose such information, imposing a duty on each public authority to publicly disclose budgetary information, procurement details, project reports and information on significant decisions and acts via websites or other means. Sri Lanka continues to fall far short of this standard of transparency and accountability.

The recent spate of citizen agitation in Sri Lanka was a collective response to the culture of opacity and corruption within State institutions and government. This has led to a heightened awareness and keen interest among the populace regarding key elements of anti-corruption including the importance of information in the fight against corruption, of how corruption flourishes in conditions of secrecy, of publicizing the asset declarations of public representatives, etc. as never seen before. As a consequence, there is now heightened pressure upon the public service and on politicians to demonstrate the practice of accountable governance.

Our country is at a critical juncture both economically and socially. It is irrefutable that this is the result of corruption. To effectively overcome this crisis, it is vital that the people must be empowered with information by public authorities. Therefore, it is essential for public authorities to take steps to be efficient, open and proactive in disclosing information. On this International Right to Know Day, TISL calls upon public authorities to look upon the right to information positively and commit to continuous improvement towards more openness. TISL’s wish for International Right to Know Day is to see citizens be part of a culture that is able to seek, receive and use information without fear or hesitation.

විනිවිදභාවය වෙනුවෙන් කැපවන ලෙස ජාත්‍යන්තර තොරතුරු දැනගැනීමේ දිනයේ දී TISL ආයතනය පොදු අධිකාරීන්ගෙන් ඉල්ලා සිටියි

මහජනයාට තොරතුරු දැනගැනීමට ඉඩ හරින විට දේශයක් සුරක්ෂිත වන බව හිටපු ඇමරිකානු ජනාධිපති ඒබ්‍රහම් ලින්කන් ජනාධිපතිවරයා වරක් පවසා ඇත. රටක උන්නතිය උදෙසා තොරතුරුවලට ඇති ප්‍රවේශයෙහි වැදගත්කම ඉන් අදහස් කෙරේ. පුරවැසි අයිතිවාසිකමක් බවට පත්ව ඇති තොරතුරු දැනගැනීම පිළිබඳ ජාත්‍යන්තර වශයෙන් කතිකාවතක් ඇති කර එය සාමාන්‍ය ජන විඥානයේ කොටසක් බවට පත් කිරීමේ අරමුණෙන් සැප්තැම්බර් 28 වන දින ‘ජාත්‍යන්තර තොරතුරු දැනගැනීමේ දිනය – International Right to Know Day’ ලෙස සැමරීම ආරම්භ විය. පසුකාලීනව එක්සත් ජාතීන්ගේ සංවිධානය විසින් ‘තොරතුරු සඳහා විශ්ව ප්‍රවේශය සඳහා වූ ජාත්‍යන්තර දිනය – International Day for the Universal Access to Information’ ලෙස මෙදින නම් කරන ලදි.

ශ්‍රී ලංකාව පුරා දූෂණය සහ වංචාව පිළිලයක් මෙන් පැතිර පවතියි. එය තුරන් කිරීමේ සාමූහික ප්‍රයත්නයට සහාය වීමේ 20 වසරක සිය මෙහෙවර ට්‍රාන්ස්පේරන්සි ඉන්ටනැෂනල් ශ්‍රී ලංකා ආයතනය විසින් සිහිපත් කරන මොහොතක මෙම දිනය සැමරීම සුවිශේෂ කාරණයකි. තොරතුරු දැනගැනීමේ අයිතිය ලාංකිකයන් හට හිමි වූ දා පටන් රටවටා ජනතාව සමඟ ඒකාත්මික වෙමින් මහජනතාවගේ තොරතුරු දැනගැනීමේ අයිතිය තහවුරු කිරීමට ට්‍රාන්ස්පේරන්සි ඉන්ටනැෂනල් ශ්‍රී ලංකා ආයතනය කැප වී කටයුතු කරයි.

සක්‍රිය ජනතා සහභාගිත්වයකින් දූෂණය මුලිනුපුටා දැමීමට තොරතුරු දැනගැනීමේ අයිතිය තරම් ප්‍රබල මෙවලමක් මෙතුවක් බිහි වී නොමැත. එයට හේතුව නම් පොදු අධිකාරීන් ලෙස හඳුන්වනු ලබන ආයතන ජනතාවට වගවිය යුතු බවට වන අවශ්‍යතාව තෘප්ත කරන නෛතික උපාංගය තොරතුරු දැනගැනීමේ අයිතිවාසිකම පිළිබඳ පනත වීමය. ජාත්‍යන්තර තොරතුරු දැනගැනීමේ දිනය වැනි දිනයක් ස්ථාපිතව ඇත්තේ පුරවැසි අයිතිවාසිකමක් උදෙසා තමා සැබෑ ලෙසම කැප වී කටයුතු කරනවාදැයි පොදු අධිකාරීන් ස්වයං නිර්ණයකට එළැඹීමටත්, තොරතුරුවල නාමයෙන් පුරවැසියන් වෙත ලබා දී ඇති අප්‍රමාණ බලය පිළිබඳ දැනුම්වත්භාවයක් ඇති කර ගැනීමටත් විනා හුදු නාමික සැමරුමකට නම් නොවේ.

ලොව පුරා රටවල් නෛතික ප්‍රතිපාදන හරහා විවිධ මට්ටම්වලට මෙම අයිතිය පුරවැසියන් වෙත ලබා දී තිබේ. රජයේ අමාත්‍යාංශ, රජයේ දෙපාර්තමේන්තු, රාජ්‍ය සංස්ථා, පළාත් පාලන අධිකාරීන්, පළාත් සභාවකින් ස්ථාපිත කෙරෙන කවර හෝ ආයතන, රාජ්‍ය නොවන සංවිධාන, උසස් අධ්‍යාපන ආයතන, පුද්ගලික අධ්‍යාපන ආයතන, සියලුම අධිකරණ, විනිශ්චය සභා සහ යුක්තිය පසිඳලීම පිණිස ස්ථාපිත ආයතන ශ්‍රී ලංකාවේ පොදු අධිකාරීන් ගණයට අයත් වේ. මෙම අධිකාරීන් කාර්යක්ෂමව සහ විනිවිදභාවයෙන් යුතුව යාවත්කාලීන තොරතුරු ජනතාවට ලබා දිය යුතු බවට වන වගකීමක් තොරතුරු දැනගැනීමේ අයිතිවාසිකම පිළිබඳ පනත මගින් නියම කර ඇත. පනතෙහි ප්‍රතිපාදනවලට අනුගත වීම තුළින් ම මෙම ආයතනවල විනිවිදභාවය සහ වගවීම ප්‍රවර්ධනය වීමත්, සිය ප්‍රජාතාන්ත්‍රික අයිතියෙන් පුරවැසියා සවිබල ගැන්වීමත් සිදු වේ.

එමෙන්ම, තොරතුරක් ඉල්ලා සිටීමට පෙර ලබා දීම, එනම් ප්‍රගාමී අනාවරණය යනු විවෘත ආණ්ඩුකරණයෙහි සහ තොරතුරු අයිතියෙහි මූලික ගුණාංගයකි. තොරතුරු දැනගැනීමේ අයිතිවාසිකම පිළිබඳ පනත මගින් පොදු අධිකාරීන් වෙත එලෙස තොරතුරු අනාවරණය කිරීමට නියම කොට ඇත. එනම් අයවැය වාර්තා, ප්‍රසම්පාදන තොරතුරු, ව්‍යාපෘති වාර්තා සහ අනෙකුත් වැදගත්කමක් උසුලන ඕනෑම තොරතුරක් වෙබ්අඩවි මාර්ගයෙන් හෝ වෙනත් ක්‍රමවලින් ජනතාව වෙත ලබා දීම පොදු අධිකාරීන් සතුව පවතින වගකීමකි. නමුත් එවැනි විනිවිදභාවයක් සහ වගවීම පිළිබඳ හැඟීමකින් කටයුතු කරන සංස්කෘතියක් අප රට තුළ දක්නට තිබෙන බවක් නොහැඟේ.

තොරතුරු අනාවරණය කිරීම වෙනුවට තොරතුරු ජනතාවගෙන් සඟවන සංස්කෘතියක කොටස්කරුවන් වීම නිසා පොදු අධිකාරීන් ඇතුළු සමස්ත රාජ්‍ය පාලනයට එරෙහිව ලාංකේය ජනතාව වෙතින් අරගලයක් මතු විය. තොරතුරුවල වැදගත්කම, පුරවැසියෙකු ලෙස තමා සතු බලය, තොරතුරුවලට ප්‍රවේශයක් නොමැති විට දූෂණය සක්‍රිය වන ආකාරය, දූෂණය මැඩලීමට තමා සතු මෙවලමෙහි ඇති වටිනාකම, දේශපාලනඥයන්ගේ වත්කම් සහ බැරකම්වල අඩංගු තොරතුරු ප්‍රසිද්ධියට පත් කිරීම යනාදී කරුණු පිළිබඳ පෙර නොවූ විරූ අවබෝධයක් සහ ඒ සම්බන්ධයෙන් තව තවත් දැනුමින් සන්නද්ධ වීමේ පිපාසයක් පුරවැසියන් හට ඇති විය. එහි බලපෑමට යටත්ව, පෙරට වඩා කාර්යක්ෂම සහ පැහැදිලි වෙනසකින් යුත් ජනතා සේවයක් වෙනුවෙන් කැපවීමට දේශපාලනඥයන් සහ පොදු අධිකාරීන්ට සිදුව ඇත.

අප රට ආර්ථික සහ සමාජයීය වශයෙන් තීරණාත්මක යුගයක් පසු කරමින් සිටියි. එම තත්ත්වය උදා වූයේ පුරවැසි අයිතිවාසිකම යටපත් කරගනිමින් දූෂණය පැන නැගි නිසා බව අවිවාදිතය. පුරවැසියන් සවිබල ගැන්වීමට නම් ජනතාවට පහසුවෙන් තොරතුරු වෙත ප්‍රවේශ වීමේ හැකියාව තිබිය යුතු අතර ඒ වෙනුවෙන් පොදු අධිකාරීන්ගේ කාර්යක්ෂම, විවෘත සහ ප්‍රගාමී ක්‍රියාකලාපය අනිවාර්ය වේ. මෙම පනත ධනාත්මකව සලකා, ජනතාවගේ තොරතුරු දැනගැනීමේ අයිතිය වෙනුවෙන් කැපවන ලෙස ජාත්‍යන්තර තොරතුරු දැනගැනීමේ දිනයේ දී ට්‍රාන්ස්පේරන්සි ඉන්ටනැෂනල් ශ්‍රී ලංකා ආයතනය පොදු අධිකාරීන්ගෙන් ඉල්ලා සිටියි. අප රටේ පුරවැසියන් තමා සතු අයිතිවාසිකම අවබෝධ කරගත්, නොබියව තොරතුරු විමසන සංස්කෘතියක කොටස්කරුවන් වනු දැකීම ජාත්‍යන්තර තොරතුරු දැනගැනීමේ දින අපගේ අපේක්ෂාවයි.

அமெரிக்காவின் முன்னாள் ஜனாதிபதியான ஆபிரகாம் லிங்கன் குறிப்பிடுகையில் “பொதுமக்கள் தகவல்களை அறிந்துகொள்ள இடமளிக்கும் போது நாடு பாதுகாப்பானதாகவிருக்கும்” என குறிப்பிட்டார். இக்கருத்தானது ஒரு நாட்டின் வளர்ச்சிக்கு தகவல் அணுகலானது எவ்வளவு முக்கியத்துவமானது என்பதை குறிக்கின்றது. சர்வதேச தகவல் அறியும் தினமானது தகவல் அணுகல் தொடர்பான சர்வதேச உரையாடலை உருவாக்குவதற்காக ஆரம்பிக்கப்பட்டது. பின்னர் ஐக்கிய நாடுகள் சபையானது செப்டம்பர் மாதம் 28ம் திகதியினை உலகளாவிய தகவல் அணுகலுக்கான சர்வதேச தினமாக பிரகடனப்படுத்தியது.

சர்வதேச தகவல் அறியும் தினத்தை அனுஷ்டிக்கும் இவ்வேளையில் ட்ரான்ஸ்பேரன்சி இன்டர்நெஷனல் ஸ்ரீ லங்கா (TISL) நிறுவனமானது ஊழலுக்கு எதிரான கூட்டு முயற்சியில் தனது 20வது ஆண்டை இலங்கையில் பூர்த்தி செய்கிறது. அதேபோல் இலங்கையில் தனது செயற்பாட்டினை ஆரம்பித்த காலம் முதல் தகவல் அறியும் உரிமையை உறுதி செய்வதற்கும் அதனை பாதுகாப்பதற்கும் முயற்சிக்கும் அதேவேளை பிரஜைகளின் RTI பயணத்தில் தொடர்ந்தும் பங்களித்து அவர்களுடன் பயணிக்கிறது.

ஊழலுக்கு எதிரான போராட்டத்தில் தகவல் அறியும் உரிமையானது மிகவும் வலிமைமிக்க கருவியாகும், பொது அதிகாரசபைகள் மீது இந்த தகவல் அறியும் உரிமையானது கடமையொன்றாக பிரதிபலித்து ஓர் கட்டாய சட்ட பொறிமுறையூடாக நாட்டின் பிரஜைகளுக்கு பொறுப்புக்கூற மற்றும் கடமைகளை உணர்ந்து செயற்படக்கூடியவர்களாகவும் காணப்படுகின்றன. சர்வதேச தகவல் அறியும் தினமானது வெறுமனே அனுஷ்டிப்பதற்கான நாள் அல்ல, மாறாக உரிமை தொடர்பில் ஆழமான மற்றும் பரந்த அறிவினை அல்லது விளக்கத்தினை உருவாக்குவதற்கான ஓர் தருணமாகும். மேலும் பிரஜைகளின் இறையாண்மை உரிமைக்காக பொது அதிகாரிகள் உண்மையிலேயே தமது வேலையினை செய்கிறார்களா என்பதை பற்றி அவர்கள் சிந்திக்கத் தூண்டும் ஒரு தருணமாகும்.

உலகிலுள்ள நாடுகள் அனைத்தும் அவர்களது அரசியலமைப்பின் விதிமுறைகள் மூலமாக இந்த சட்டபூர்வ உரிமையை பெற்றுள்ளார்கள் மற்றும் பல்வேறு மட்ட அளவீடுகளில் பொது அதிகாரசபைகள் மீது இவை கடமையாகின்றது. அமைச்சுக்கள், அரச திணைக்களங்கள், பொது நிறுவனங்கள், உள்ளுராட்சி மன்றங்கள், மாகாண சபைகளினால் உருவாக்கப்பட்ட நிறுவனங்கள், அரச சார்பற்ற நிறுவனங்கள், உயர்கல்வி நிறுவனங்கள், தனியார் கல்வி நிறுவனங்கள் மற்றும் அனைத்து நீதிமன்றங்கள், நியாய சபைகள் மற்றும் நீதிச் சேவைக்காக உருவாக்கப்பட்ட நிறுவனங்கள் என்பன இலங்கையின் “பொது அதிகாரசபைகள்” எனும் பதத்தினுள் உள்ளடங்குகிறது. பொதுமக்களுக்கு தகவல்களை வினைத்திறனாகவும் வெளிப்படைத்தன்மையுடனும் வழங்குவதற்கு மேற் குறிப்பிட்ட அதிகார சபைகள் மீது இந்த தகவல் அறியும் உரிமைச் சட்டமானது கடமைப்பட்டுள்ளது. சட்ட ஏற்பாடுகளுக்கு இணங்குவதனூடாக இந்த அதிகார சபைகளின் வெளிப்படைத்தன்மை மற்றும் பொறுப்புக்கூறலை மேம்படுத்தி பிரஜைகள் தமது ஜனநாயக உரிமைகளை பயன்படுத்த வழிவகுக்கும்.

மேலும் தகவல்களை கோருவதற்கு முன்னரே தகவல்களை வழங்குதல், அதாவது தகவல்களை தாமாக வெளிப்படுத்தல் ஆனது, திறந்த அரசாங்கத்திற்கும் தகவல் அறியும் உரிமைக்கும் முதன்மையான அம்சங்களில் ஒன்றாகும். பொது அதிகார சபைகள் அத்தகைய தகவல்களை பொதுமக்களுக்கு வெளிப்படுத்த வேண்டும் என தகவல் அறியும் உரிமைச் சட்டம் ஆணையிடுகிறது. ஒவ்வொரு பொது அதிகார சபையும் அவர்களது வரவு-செலவு திட்ட தகவல்கள், கொள்முதல் விபரங்கள், திட்ட அறிக்கைகள் மற்றும் முக்கிய/ குறிப்பிடத்தக்க தீர்மானங்கள் மற்றும் நடவடிக்கைகள் தொடர்பான தகவல்களை இணையதளங்கள் அல்லது பிற வழிகள் ஊடாக பகிரங்கமாக வெளியிடுவதற்கு கடமைப்பட்டவர்களாவர். இலங்கையானது இவ்விடயங்களை முறையாக பின்பற்றுவதில் தொடர்ந்தும் பின்தங்கியே காணப்படுகிறது.

இலங்கையின் சமீபத்தைய மக்கள் எழுச்சியானது அரச நிறுவனங்கள் மற்றும் அரசாங்கத்திற்குள்ளே காணப்படுகின்ற ஒளிவுமறைவு மற்றும் ஊழல் சார் கலாச்சாரத்திற்கு எதிரான ஓர் கூட்டு பிரதிபலிப்பாகும். ஊழலுக்கு எதிரான போராட்டத்தில் தகவலின் முக்கியத்துவம், தகவல் அணுகலுக்கு சந்தர்பமில்லாதவிடத்து இரகசியமான நிலையில் அதிகரிக்கும் ஊழல், மக்கள் பிரதிநிதிகளின் சொத்து மற்றும் பொறுப்புக்கள் தொடர்பான பிரகடனங்கள் வெளியிடல் உள்ளிட்ட ஊழலுக்கு எதிரான முக்கிய பகுதிகள் குறித்து பொது மக்களிடையே இதுவரை கண்டிராத அதிக விழிப்புணர்வு மற்றும் ஆர்வத்தை ஏற்படுத்தியுள்ளது. இதன் விளைவாக, பொதுச் சேவை மற்றும் அரசியல்வாதிகள் மீது அதிக பொறுப்புணர்வுடன் கூடிய நிர்வாக கட்டமைப்பை நடைமுறைப்படுத்துவதற்கான அழுத்தங்கள் தற்பொழுது அதிகரித்துள்ளன.

எமது நாடு பொருளாதார ரீதியாகவும் சமூக ரீதியாகவும் ஓர் இக்கட்டான கட்டத்தில் காணப்படுகிறது. இது ஊழல் நிறைந்த பாதையின் ஓர் அடைவினை எட்டியுள்ளது. இந்த நெருக்கடியில் இருந்து மீள, மக்களுக்கு தகவல்களை பெற்றுக்கொள்வதற்கான அதிகாரம் வழங்கப்பட வேண்டியது இன்றியமையாததாகும். இன்றைய தகவல் அறியும் தினத்தில், ட்ரான்ஸ்பேரன்சி இன்டர்நெஷனல் ஸ்ரீ லங்கா நிறுவனமானது பொது அதிகாரசபைகளிடம் பொதுமக்களினது தகவல் அறியும் உரிமையினை சாதகமான விடயமொன்றாக உற்றுநோக்குமாறும் வெளிப்படைத்தன்மயைை நோக்கிய தொடர்ச்சியான முன்னேற்றத்திற்கு உறுதியளிக்குமாறும் கேட்டுக்கொள்கிறது. எமது நாட்டுப் பிரஜைகள் தமக்குரிய உரிமைகளை புரிந்துக்கொண்டு எந்தவொரு அச்சமும் தயக்கமுமின்றி தகவல் அறியும் உரிமையினை பயன்படுத்தக்கூடிய கலாசாரத்தின் பங்காளர்களாக அவர்கள் இருக்க வேண்டுமென்பது இன்றைய தகவல் அறியும் உரிமை தினத்தின் எதிர்பார்ப்பாகும்.
