			<content:encoded><![CDATA[<p>The Presidential Election 2010 recorded unprecedented levels of abuse of public resources commencing from the Nomination Day (December 17 2009). The Program for Protection of Public Resources (PPPP) of Transparency International Sri Lanka (TISL) has received over 400 complaints (excluding complaints of election violence) as of 23rd January 2010, and upon investigation, have confirmed the following grave abuses:</p>
<p><span id="more-480"></span></p>
<p> (a)The Sri Lanka Transport Board (SLTB) buses were regularly used to transport supporters of the UPFA for their meetings in all districts. The PPPR can confirm that 1042 SLTB buses were used for this purpose.</p>
<p>(b) State facilities were abused. These include the use of Temple Trees, and telecommunication, electricity &amp; printing facilities of state enterprises such as Lake House.</p>
<p>(c) Involvement of Public Officials in the election campaign, violating the Establishment Code – particularly, Secretaries of certain Ministries, Secretary to the President and political appointees to the Sri Lanka Foreign Service.</p>
<p>(d) Certain public institutions and their facilities were used for the campaign of the President.</p>
<p>It is unfortunate to note that the non-appointment of an Election Commission under the 17th amendment to the constitution has paved the way for these violations to reach unprecedented levels. Further, the disregard for law and order, particularly the disregard of the directives of the Elections Commissioner by the Secretaries of Ministries and State Corporations, signified the failing democratic values in Sri Lanka. The abuses continued even during the &#8220;no campaign period&#8221; in the last two days prior to Election by illegally transferring senior police officers and by the government continuing with its campaign in public owned electronic and print media.</p>
<p>Throughout the election campaign, the State media blatantly flouted the election laws and regulations. All state media institutions were involved in propaganda work for the UPFA candidate, disregarding the directions issued by the Elections Commissioner. Thus the state media failed to provide an equal opportunity to other candidates in the Election.</p>
<p>The Elections Commissioner himself cannot ensure a free and fair election without the cooperation of the public services, candidates and political parties. An independent public service is a prerequisite for a free and fair poll.  Further, the implementation of the 17th Amendment and the strengthening of the election laws are imperative to enhance the integrity of the election process.</p>
<p>The Presidential Election 2010 will go down in the electoral history in Sri Lanka as a shameful one, leaving scars on democracy. The blatant violation of laws governing integrity of the election process clearly undermined free choice of the people and distorted the true reflection of the choice of the Sri Lankans.<br />
Note: The PPPR has released four interim reports, one special report on the cost of elections and one interim report on electronic media monitoring. The final report will be released in the month of February 2010.</p>

<p>The police have warned that they will be compelled to shoot on sight if any group or individual ignores the law and attempts to incite violence during the Presidential elections.</p>

<p>Senior DIG of the police elections unit Gamini Navaratna, speaking to Daily Mirror online, said that the police are empowered to implement the law under the Presidential elections act of 1981.</p>
<p>He said that at first the police will issue a warning to anyone attempting to create violence including damaging property at a polling booth and if the warning is not respected then the police have orders to open fire.</p>
<p>The DIG also said there are no immediate plans to have a police curfew during the elections as, according to him, they do not expect any serious mass scale incidents to break out.</p>

Senior Deputy Inspector General (DIG) of police Nimal Lewke, who is in charge of operations in the North, has been recalled to the police headquarters in Colombo.</p>

<p>When contacted by Daily Mirror online DIG Lewke confirmed that he has been asked to report to Colombo and carry out his duties as DIG in charge of Northern operations from the police headquarters in Colombo.</p>
<p>Police transfers ahead of a Presidential election is a violation of election laws. However when contacted a senior police source insisted the DIG was not being transferred and will continue to hold on to his previous post but will operate from Colombo and be given additional duties.</p>
<p>The Election Commissioner on 7th December ordered all government departments, institutions, corporations and other entities not to hire, promote or transfer any employee until the presidential election results are released.</p>

			<content:encoded><![CDATA[<p>The Australian government yesterday expressed its hope that the forthcoming election will be free and fair in Sri Lanka, news.com.au reported. Australian Foreign Minister Stephen Smith said Sri Lanka would have “a very difficult peace and security environment for the foreseeable future”. The Australian Government hoped its current election process would be free and fair, he said.</p>
<p><span id="more-466"></span></p>
<p>“The Sri Lankan Government having won the war, now needs to win the peace by presenting all people from Sri Lanka with a role in the political outcome and a role in the democratic processes,” he said.</p>
<p>He also said that the dangers of the monsoon season are not expected to deter asylum seekers from trying to reach Australia by boat.</p>
<p>The prospect of cyclonic weather between December and April had been expected to halt or slow the rate of boats sailing for Australia with asylum seekers from Afghanistan and Sri Lanka aboard. But since Friday, authorities have intercepted another two unauthorised boats off Western Australia&#8217;s north coast, carrying about 70 suspected asylum seekers.</p>
<p>This brings the number of asylum seekers intercepted in the first three weeks of 2010 to more than 250, putting more strain on the Christmas Island detention centre with its capacity of just 1850 refugees.</p>
<p>Mr. Smith said the Government was continuing to face a &#8220;global people movement problem&#8221; which was also burdening southern Asian nations including Indonesia, Malaysia and Sri Lanka.</p>
<p>He said the main &#8220;push factors&#8221; sending unauthorised arrivals to Australian shores were continuing conflict in Afghanistan and its border areas with Pakistan, and the fall-out from the Sri Lankan war.</p>
<p>&#8220;I have made (this) clear, given the state of peace and security in Afghanistan and the Afghanistan-Pakistan border area and the difficulties Sri Lanka has seen over recent times,&#8221; Mr Smith said.</p>
<p>Asked about Indonesia&#8217;s latest call for Australia to help resolve a long-running stand-off with asylum seekers at Merak, in Java&#8217;s west, Mr. Smith said former ambassador to Indonesia Richard Woolcott would be travelling to Jakarta soon to discuss the issue with local authorities. More than 240 Sri Lankan asylum seekers have spent more than three months holed up on the rickety cargo boat at Merak. Mr. Smith said Mr. Woolcott continued to speak regularly with Indonesian officials, even though he had not travelled to the country for some time.</p>

<p>මීට කලින් තිබුණ හැම මැතිවරණයකටම වඩා මේ මැතිවරණය නිදහස් හා සාදාරණ අයුරින් පවත්වන්න ට මැතිවරණ කොමසාරිස්තුමා සිය උපරිමයෙන් උත්සාහ කරලා තියනවා. මැතිවරණ ප්‍රතිඵල ප්‍රකාශය ට පත්කිරීමේ දී පවා වෙනත් පාර්ශ්වයක ට කිසියම් බලපෑමක් කරන්නට බැරි වෙන විදිහට නව තාක්ෂණික ක්‍රමවේදයන් මගින් සියළුම මාධ්‍යයන් ට එකවර ප්‍රතිඵල නිකුත් කරන ක්‍රමවේදයක් එතුමා හදුන්වා දී තියනවා. ඒ  සම්බන්ධයෙන් නිරීක්ෂකයන් වශයෙයන් අපිට සෑහීමකට පත්විය හැකියි. රජයේ නිලධාරින්ගෙනුත් අප ඉල්ලා සිටින්නේ තමන්ගේ හෘද සාක්ෂියට සහ නීතියට අනුව කටයුතු කරන ලෙසයි. එහෙම කටයුතු කිරීම නිසා යම් ගැටළුවක් ඇති වුණොත් ඒ සම්බන්ධයෙන් අවශ්‍ය නීතිමය සහ සමාජමය ආරක්ෂාව ලබාදෙන්නට අප සූදානම්Z යැයි ද වැලිඅමුණ මහතා වැඩිදුරටත් ප්‍රකාශ කෙළේය.</p>
<p>නිදහස් හා සාධාරණ මැතිවරණයක් සඳහා ජනතා ක්‍රියාකාරීත්වයේ සභාපති රෝහණ හෙට්ටිආරච්චි මහතා මාධ්‍ය හමුව අමතමින් ඡන්ද දායකයන් විශේෂයෙන් අවධානය යොමුකළ යුතු කරුණු කිහිපයක් පෙන්වා දුන්නේය.<br />
මේ වන විට නිල ඡන්ද දැන්වීම් පත්‍රිකා ඛෙදීම අවසන් අදියරට පැමිණ ඇති බැවින් තවමත් නිල ඡන්ද දැන්වීම් පත්‍රිකා නොලැබුණ ඡන්දදායකයෙක් වේ නම් 25 වන සදුදා දිනයේ තමන්ගේ ප්‍රදේශයේ තැපැල් කාර්යාලයට ගොස් ඒ ගැන සොයා බලන ලෙසත් නිල ඡන්ද දැන්වීම් පත්‍රිකාව ඇතත් නැතත් ඡන්ද නාම ලේඛනයේ නම් ඇති අයට ඡන්දය ප්‍රකාශ කිරීමේ අයිතිය හිමි බවත් හෙතෙම අවධාරණය කෙළේය. එබැවින් නිල ඡන්ද දැන්වීම් පත්‍රිකා නොලැබුණ අයෙකුට වුව ද මැතිවරණ කොමසාරිස්වරයා විසින් පිළිගන්නා හැදුනුම් පතක් රැගෙන ඡන්ද මධ්‍යස්ථානය වෙත ගොස් සිය ඡන්දය ප්‍රකාශ කිරීමේ හැකියාව ඇති බැවින් උදෙන්ම ඡන්ද මධ්‍යස්ථානය වෙත ගොස් ඡන්දය ප්‍රකාශ කිරීමට පියවර ගන්නා ලෙස ද හෙතෙම මහජනතාවගෙන් ඉල්ලා සිටියේය.</p>
<p>zපෞද්ගලික සේවයේ නියුතු සෑම කෙනෙකුටම ඡන්දය ප්‍රකාශ කිරීම සඳහා අවම වශයෙන් පැය හතරක වැටුප් සහිත නිවාඩුවක් හිමියි. .යම් හාම්පුතෙක් එය ලබාදීම පැහැර හැරියොත් ඊට එරෙහිව නඩු පැවරිය හැකියි. ඡන්දය පාවිච්චි කරන ආකාරය ගැනත් යම් යම් අයට අපැහැදිලිතා තියනවා. මැතිවරණ කොමසාරිස්වරයා මීට සුළු මොහොතකට කලින් අප සමග පැවැති සාකච්ඡාවෙදි ප්‍රකාශ කළා ඒ ගැන පැහැදිලි කිරීමක් කරන්නට බලාපොරොත්තු වෙන බව. තමන් කැමැති අපේක්ෂකයාගේ නම ඉදිරියේ ඇති කොටුවේ කතිරය සළකුණු කිරීමෙන් හෝ අංක 1 සළකුණු කිරීමෙන්  යන දෙයාකාරයෙන් එක් ආකාරයකට ඡන්දය ප්‍රකාශ කළ හැකියි ද හෙට්ටිආරච්චි මහතා වැඩිදුරටත් පැවසීය.</p>

			<content:encoded><![CDATA[<p>A SERIOUS MATTER OF CONCERN<br />
This special report of the Programme for Protection of Public Resources (PPPR) of Transparency International Sri Lanka (TISL) relates to the cost of election propaganda to give an accurate picture of the costs incurred by political parties and the State for the conduct of the Presidential Election 2010. PPPR hopes to finalize the computation of the total cost of the conduct of the Election by end February. This report has been prepared to give an indication of the nature of the costs incurred so that voters and policy makers can form an opinion on the economic costs of the election in which they elect the head of the State.</p>
<p>2010 ජනාධිපතිවරණයේ ප්‍රචාරක කටයුතු සඳහා දේශපාලන පක්ෂ සහ රජය විසින් වැය කරනු ලබන මුදල් පිළිබ`දව නිවැරදි තත්ත්වය දැක්වීම ස`දහා ට්‍රාන්ස්පේරන්සි ඉන්ටනැෂනල් ශ්‍රී ලංකා ආයතනයේ පොදු දේපල රැකගැනීමේ වැඩසටහන විසින් මෙම විශේෂ වාර්තාව පිළියෙල කර ඇත. ජනාධිපතිවරණය සඳහා වැයවන මුලූ මුදල සම්බන්ධයෙන් සම්පූර්ණ වාර්තාවක් 2010 පෙබරවාරි අගදී නිකුත්කිරීමට බලාපොරොත්තුවේ. රජ්‍ය නායකයකු තෝරාගැනීමේදී ආර්ථීක මට්ටමින් රටට දැරීමට සිදුවන වියදම් පිළිබඳව ඡන්දදායකයින් සහ ප්‍රතිපත්ති සකස්කරන්නවුන් දැනුවත් කිරීම මෙම වාර්තාවේ අරමුණයි. </p>
